Council Meeting Minutes for May 6, 2024

The Regular Meeting of the Apple Creek Council called to order on May 6th, 2024 at 6:47 P.M. and then for with the following council members answering to

 

ROLL CALL: CM Adkins - present, CM Conrad - present, CM Harwood - excused, CM Lewis - present, CM McCarthy - present, and CP Stoffer – excused.

 

Also in attendance:  Interim Police Chief Spademan, Street Superintendent Swysgood, and FO Jennifer Mohler

 

Motion to approve the minutes of the April 15th, 2024 meeting.  As always, they are available for the public to review.

SAFETY TIP:

Cory Orr:  With nice weather arriving, practice defensive driving to avoid bicycles and motorcycles that will be sharing the road with you as well as children possibly running in the road. 

 

VISITORS:

POLICE:

Interim Chief Spademan:

-On April 18th, the chief, Mayor Mackey and Mount Eaton Mayor Irwin attended the Children’s Services Bureau Luncheon.  Nice lunch was provided and awards were handed out. 

-Council packets have a pie chart that show the breakdown of call volume for a year.  The schedule is being adjusted to cover the busier times.  Sgt Allison is working Monday evenings now as that had a higher call volume and our part time officer is able to pick up an additional shift.

-Monthly call breakdown is in the council packet.

-There were no questions for Interim Chief Spademan

 

PARK:

   Street Superintendent Swysgood:

  - Had 15 trees trimmed of dead limbs for maintenance of grounds

            -Holmesville Electric serviced park for maintenance of electric and Johnny Appleseed for safety and service

 

 

STREETS AND MAINTENANCE:  

Street Superintendent Swysgood:

          - Catch basins on Reed and intersections of Villard, Ash and Reed were replaced

-Continued on waterline project for Villard Street.  Waterline is done, sidewalk was put in today.  Just need to   do the yard work

-Removed balance of broken concrete salvaged from village jobs to protect the banks at garage area of       Apple Creek (pictures of this were provided to council)

-Set up meter read for new Waynedale school.  They are going to give us a code to the pump house so we can go in and read the meter instead of running a cord through the new brick building.

-Mayor Mackey passed around pictures from the Villard Street project work this week.

 

WATER & SEWER:   

            -Evaluating pumps and vendor at water plant

           - New UV lights arrived to treat wastewater before it leaves our property

           - Replaced the curb box at 444 East Main St-Village side water leak

Set dates for 2024 meetings at the village hall at 6:00pm: April 3rd, July 10th, October 9th, January 8th, 2025   April 3rd meeting was cancelled

 

CORRESPONDENCE:

-Received a check from MCTV for $513.31 which is our 1% revenue from video services in the village

-Mayor Mackey went to ODOT today to get an update on what was going to happen when they start to work on SR 250 west of town.  They will have traffic down to one lane and are using 6 lights and will have a traffic control crew there during the project.  Traffic will be impacted.  Work is supposed to start today (May 6th) and last through October of this year.

 

NEW BUSINESS:

-Mayor Mackey discussed the repairs needed to SR 250 in the village.  No money was put in this year’s budget for repairs to SR 250 as council has had concerns about spending money to repair it.  We put over $100,00 in the road in the last two years.  There are two holes currently in the state route. 

-We received the quote today on the cost of materials for the streets we discussed.  Supt Swysgood and the mayor will go over the quote and report back to council.

 

UNFINISHED BUSINESS:

-RITA:

Apple Creek $72921.59   JEDD II $3829.38   JEDD I ?  Jen is working with RITA to figure out why they are showing no payments for JEDD I.  If not resolved, Mayor will call Matt Mau to fix the problem.

     - The need for a delegate and alternate delegate for Apple Creek to have the ability to vote on official RCOG (Regional Council of Govts) such as election of individuals to the RITA Board of Trustees has already listed Jennifer Mohler as a delegate and Mayor Mackey as an alternate.

      - Mayor Mackey advised council that we were under the impression that RITA was going after non-filers, but apparently that wasn’t set up.  Therefore, we have signed up for RITA to go after non-filers for no additional cost to the village and if they don’t file/pay, then RITA will send a subpoena with a cost of $1.00/subpoena. 

 

Resolution No. 2024-07

A RESOLUTION PERMITTING LIMITED ALTERATION OF A DRAINAGE DITCH ON SPRING RUN PURSUANT TO THE PREAPPROVED PLANS SUBMITTED TO THE VILLAGE

 

Resolution No. 2024-08

A RESOLUTION ACCEPTING A FIVE-YEAR EXTENSION BID OF KIMBLE RECYCLING & DISPOSAL, INC. FOR WASTE REMOVAL SERVICES AND AUTHORIZING THE MAYOR OF THE VILLAGE OF APPLE CREEK TO EXECUTE SAID CONTRACT ON BEHALF OF THE VILLAGE: AND DECLARING AN EMERGENCY

 

Resolution 2024-09

 RESOLUTION AUTHORIZING PARTICIPATION IN THE ODOT ROAD SALT CONTRACTS AWARDED IN 2024 AND DECLARING IT AN EMERGENCY

 

No action taken on these three resolutions as there was not the required amount of council members present.  (NOTE: A special meeting will be held May 10th at 5pm at village hall to discuss these resolutions)

 

Ordinance No. 2024-10

 AN ORDINANCE AMENDING §94.02 (B)(2) OF THE CODIFIED ORDINANCES OF THE VILLAGE OF APPLE CREEK, OHIO

 

First reading of Ordinance No. 2024-10.

MOTION by CM Conrad, seconded by CM McCarthy.

ROLL CALL: CM Adkins - yes, CM Harwood - excused, CM Lewis - yes, CM Conrad – yes, CM McCarthy-yes and CP Stoffer-excused.  There was a discussion on the fine for violating this ordinance.

MOTION TO go in to Executive Session for Property Security Matters ORC 121.22 and Personnel Section 121.22 (G)(1) Hiring

 

Motion by CM Conrad. The motion was seconded by Adkins. Time: 7:19 PM

All members present in the executive meeting agreed to hold a special meeting on May 10, 2024 to discuss Resolutions 2024-07, 2024-08, and 2024-09.
